THE HON'BLE SRI JUSTI CE M.S.K. JAI SWAL WRI T PETI TI ON No.16013 of 2006 ORDER:

The grievance of the writ petitioner is that the order of this Court in W.P.No.19198 of 1997, as confirmed in W.A.No.1937 of 1999, has not been implemented by the authorities.

It is noticed from the record that the original punishment that was inflicted against the petitioner was removal from service, which was confirmed by the Labour Court. In the writ petition filed by the writ petitioner challenging the award of the labour court, this court directed respondents Nos.2 & 3 therein, who are the respondents herein, to reinstate the petitioner into service with continuity of service, but without any other benefits, like back wages etc. The said order was confirmed in writ appeal. However, in the order of the writ appeal, by mistake, it was mentioned as with 'no' continuity of service, and subsequently, on 03.03.2005, the word 'no' has been deleted in the order. However, the fact remains that the order of this court in W.P.No.19198 of 1997 was confirmed.

It is manifest from the above that the respondents are to implement the order in W.P.No.19198 of 1997 and the grievance of the writ petitioner is that the same is not being implemented. In that view of the matter, the Writ Petition is disposed of, directing the respondents to implement the orders of this Court in W.P.No.19198 of 1997, as confirmed and modified in W.A.No.1937 of 1999, within a period of 60 days from the date of receipt of a copy of this order. No order as to costs.

MSKJ, J W.P.No.16013 of 2006 Pending miscellaneous petitions, if any, shall stand closed in consequence.
