THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No. 836 of 2007 ORDER:
Neither is Sri V.S.R. Anjaneyulu, learned counsel for the petitioner, present nor is there any representation on his behalf. The relief sought for in this writ petition is to declare the proceedings of the Deputy Commissioner, Endowments dated 22.12.2006 as arbitrary, illegal and contrary to the provisions of A.P. Act 30 of 1987. By proceedings dated 22.12.2006, the Manager of Sri Venugopala Swamy Temple, Vijayawada was appointed as the sole trustee of Sri Venugopala Krishna Anna Satram, Kothapeta, Vijayawada. She was directed to take over complete charge of the accounts and records of the legal heirs of the founder family of the subject institution, and to report compliance. The legal heirs of the founder family were directed to hand over complete charge of the accounts.
The petitioner claims to be the great grand-son of the founder of the Annadana Satram. He is aggrieved by the appointment of the Manager of Sri Venugopala Swamy Temple as the single trustee of the Annadana Satram. The proceedings impugned in this writ petition is dated 22.12.2006, issued more than ten years ago. This court, by its order in W.P.M.P. No.1049 of 2007 dated 11.1.2007, granted interim suspension of the said order for a period of two weeks. The interim order was not extended thereafter. A Learned Single Judge of this Court, by order in W.P.M.P. No. 1049 of 2007 dated 23.2.2007, noted that the interim order granted earlier on 11.1.2007, for a period of two weeks, had expired on 25.1.2007.
The Manager of the Venugopala Swamy Temple who has been appointed as the single trustee, or her successors in office, have been holding the office of a single trustee for the past more than ten years. I see no reason at this length of time to entertain a challenge to the appointment of the 4th respondent as a single trustee, by the impugned proceedings dated 22.12.2006, as more than a decade has since elapsed.
The writ petition fails and is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
