O R D E R :
This Criminal Petition is filed by the petitioners under section 438 Cr.P.C., seeking grant of anticipatory bail to the petitioners, who are A-1 and A-3 in Crime No. 167 of 2017 of Badvel Urban Police Station, YSR Kadapa district, registered for the offences punishable under section 324, 306, 426 read with section 34 of IPC.
2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing on behalf of the respondent/State and perused the record.
3. The learned Additional Public Prosecutor draws attention of this Court to the orders passed by this Court in the earlier bail applications filed by the petitioners, seeking for grant of anticipatory bail. The first bail application was dismissed considering the merits of the case by virtue of the orders passed in Criminal Petition No. 7491 of 2017, dated 12/09/2017 and the second order is rendered in Criminal Petition No.10972 of 2017, dated 20/11/2017, wherein it was observed
that filing charge sheet is not a ground to allow the petition and that there are specific allegations against the petitioners to constitute the offences under sections 324, 306 and 426 of I.P.C. read with section 34 of I.P.C.
4. Hence, in view of the above orders, this Court cannot entertain this petition at all. The petitioners can surrender before concerned court and seek bail. On such surrender, the concerned court shall consider and dispose of the bail application on merits and in accordance with law, on the same day, subject to pressure of work.
5. In view of the above, this Criminal Petition is dismissed.
6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
