O R D E R

Aggrieved by the proceedings of the 2nd respondent - Collector and District Magistrate, Bhadradri Kothagudem District, in Rc.No.E3/2689/2016 dated 24.07.2019, in rejecting the application of the petitioner for mutation of his name in the revenue records, the present writ petition is filed. Learned counsel for the petitioner submits that though in the impugned proceedings dated 24.07.2019 it is mentioned that notice dated 10.07.2019 was served on the petitioner, the same was in fact not served on the petitioner. Learned counsel further submits that petitioner has filed documents in support of his claim, but without considering the same, the impugned order has been passed rejecting the request of the petitioner for mutation of his name in the revenue records.

Learned Assistant Government Pleader for Revenue produced record and a perusal of the same, showed that petitioner was served with notice dated 10.07.2019 and the same was acknowledged by the petitioner. In view of the above, the submission of the counsel for the petitioner that petitioner was not served with any notice, is factually incorrect. Further, the impugned proceedings show that the petitioner sought for rectification of entries after a period of about ten years, and hence on this ground, it has been held that revenue authorities have no jurisdiction to

entertain the subject matter at this length of time. No exception can be taken on this reasoning of the 2nd respondent.

Considering the facts and circumstances of the case, this court is of the view that the 2nd respondent, by recording cogent and convincing reasons, has rightly rejected the claim of the petitioner, and hence no interference is warranted.

In view of the same, the writ petition is dismissed, however, leaving it open to the petitioner to avail alternative remedies available under law. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
