O R D E R:- This writ petition is filed to declare that the action of the respondents-authorities in trying to dispossess/demolish the shops bearing H.Nos.2-195, 2196, 2-197, 4-1024, 4-7, 4-6, 4-5, 4-4, 4-3, 12-106, 12-107, 12-108, 12-109, 12-110, 12132, 12-133, 12-134, 2-190, 2-191, 2-192, 2-193, 12-111, 12/145-012/140, 12/145Q, 12/145P, 12-145Q2, 7/111=11-1, 7/111-11/2, 7/111-11-3, 1-147-1-32-4-1, 1147A32/3 and 1-147A32/4 situated on Alluru Road, Nandikotkur Town, Kurnool District, without issuing any notice or initiating acquisition or requisition proceedings, as illegal, arbitrary, unjust, improper and is in negation of the established Judicial Precedents besides in violation of Articles 21 and 300-A of the Constitution of India apart from violation of principles of natural justice, and consequently direct the respondents not to dispossess/demolish the aforesaid shops without following the due process of law.

During hearing, Sri MD. Saleem, learned Standing Counsel for Nandikotkur Municipality appearing for respondent No.2 has assured that the Municipality is not going to demolish the above premises without following due process of law.

Hence, the respondents are directed not to demolish the above premises without following the due process of law.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to the disposal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
