THE HON'BLE SRI JUSTI CE CHALLA KODANDA RAM CONTEMPT CASE NO.8 OF 2017 ORDER:

This contempt case is filed complaining non-compliance of order dated.10-03-2016 passed by this Court in W.P.M.P No.9892 of 2016 in W.P.No.7780 of 2016.

This court, while ordering notice in the writ petition, taking into consideration the specific averments therein, has directed the respondents, particularly the 4th respondent, not to interfere with the business in respect of Shop No.8 in the Tatipaka Daily Market of East Godavari District. The respondent- Tatipaka Gram Panchayat has filed a counter affidavit in the contempt case, wherein it is specifically asserted in para.11, while denying the allegations of the petition that the respondent interfered with the business activity of the petitioner, that the petitioner himself locked his shop and that he is, as on date, carrying on his business in shop No.8. However, it is stated therein that the petitioner, who was allotted shop No.

16, has refused to move and the respondent-Tatipaka Gram Panchayat had already filed vacate petition in the writ petiton and a counter-affidavit is filed in the main writ petition. Having regard to the respective submissions of the learned counsel and in the light of the categorical stand that the petitioner was not interfered with and there being no rebuttal to the counter filed on 05-022018, the contempt case is liable to be closed. Accordingly, the Contempt Case is closed.
