THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE DR JUSTICE SHAMEEM AKTHER Writ Petition No.4044 of 2017 ORDER: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} Heard Sri I.Venkata Prasad, learned counsel for the petitioner, and Sri A.Krishnam Raju, learned Standing Counsel for the State Bank of Hyderabad and, with their consent, the writ petition is disposed of at the stage of admission. The proceedings under challenge, in this writ petition, is the E-Auction Sale Notice dated 09.01.2017 fixing the date of auction as 13.02.2017.

Sri I.Venkata Prasad, learned counsel for the petitioner, would submit that the petitioner has submitted representation dated 24.11.2016 seeking one time settlement and, instead of adjudicating the petitioner's claim on merits, it would suffice if the respondents are directed to dispose of the petitioner's representation in accordance with law.

Sri A.Krishnam Raju, learned Standing Counsel for the State Bank of Hyderabad, would submit that, since the validity of the auction notice is not in issue, the respondents would proceed with the auction, and the petitioner's representation would be considered and an order passed before the sale is confirmed.

Recording the submission of the learned Standing Counsel, the Writ Petition is closed. The miscellaneous petitions pending, if any, shall also stand closed.
