HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 9696 OF 2012 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The present Writ Petition came to be filed seeking to declare the action of respondent Nos.1 to 3 in not evicting respondent No.4 from the assigned lands in Survey Nos.116-2K and 116-2L admeasuring Acs.3.00 and Acs.2.75 cents as illegal and arbitrary.

The averments in the Writ Petition would show that respondent No.4 who is alleged to have purchased the assigned lands is creating troubles to the petitioner and others who are original assignees, by encroaching on to the said lands. Inspite of several representations made to the officials seeking to resolve the said problem, no appropriate action is initiated by the official respondents. Hence this Writ Petition.

The main grievance of the petitioner is that his representation dated 15.02.2012 is not considered till date and he is sought to be dispossessed by third persons, without following due process of law.

Without going into merits of the case and having regard to the circumstances stated above, the present Writ Petition is disposed of directing respondent No.1 to dispose of the representation dated 15.02.2012, in accordance with law, as expeditiously as possible. No costs.

Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
