THE HON'BLE Dr . JUSTI CE SHAMEEM AKTHER Cr im in al Pet it ion No.4 8 5 of 2 0 1 8 ORDER:
This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused No.4, seeking to quash the proceedings against him in F.I.R.No.6 of 2018 on the file of the Ameenpur Police Station, Sangareddy District.
2 .
Heard the learned counsel for the petitioners/ accused No.4, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.
3 .
The learned counsel for the petitioner/ accused No.4 would submit that there are no specific allegations against the petitioner/ accused No.4 in the report, dated 08.01.2018, lodged with the police by the de-facto complainant. There is allegation that some of the permissions with regard to the construction of the houses were forged and ultimately prayed to allow the application.
4 .
As per the First Information Report lodged in this case, when the houses being constructed in the limits of Ameenpur Grampanchayat were inspected, it was found that 16 houses were being constructed illegally. The permission papers relating to those houses were fabricated. Out of 16 permissions, six permissions purported to have been issued by the petitioner/ accused No.4.
5 .
The question as to who have fabricated the permission papers etc., requires to be determined in the course of investigation. The matter requires thorough investigation. The proposed investigation would not cause any prejudice to the petitioner/ accused No.4. The Criminal Petition is devoid of merit and is liable to be dismissed.
6 .
Accordingly, the Criminal Petition is dismissed. Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
