THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.9713 of 2016 ORDER:

The grievance of the petitioner, a convict undergoing detention, is with regard to the failure on the part of the authorities in extending his parole by one month, i.e. up to 25.04.2016. It appears that the petitioner submitted representation dated 11.03.2016 in this regard but the learned Assistant Government Pleader for Home states, on instructions, that no such representation was received. Sri D. Purna Chandra Reddy, learned counsel for the petitioner, states that the petitioner surrendered on 25.03.2016 and is presently housed in Central Prison, Kadapa.

As the petitioner's representation is stated to have never been received by the authority concerned, this Court cannot find any fault with the authorities for their alleged inaction thereon. The writ petition is accordingly disposed of leaving it open to the petitioner to submit a fresh application for parole, if necessary. This application shall be made to the Principal Secretary to the Government, Home Department, State of Andhra Pradesh, setting out the reasons in detail as to why the petitioner is seeking such parole. In the event such application is made, the same shall be considered by the authority concerned in accordance with law. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR Date: 20.04.2016 PGS
