THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.1765 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate writ, order or direction more in the nature of Mandamus, declaring the inaction of the 2nd respondent in not fixing the boundaries for the petitioner's lands situated in agricultural lands in Survey No.73 to 84, 123, 124, 130, 208, 209, 210 & 211, of Village of Valikonda Mandal, Yadadri Bhuvanagiri District, in terms of the request made on 08.06.2018 by paying the requisite fee as being illegal, arbitrary and against the principles of natural justice and violative of Articles 14, 16, 21 and 301 of Constitution of India and consequently, direct the respondents to conduct the survey and fix up the boundaries for the aforesaid land of the petitioner forthwith and pass such other order or orders as are deemed fit and proper.'

Learned Assistant Government Pleader for Revenue, State of Telangana, would point out that though the petitioner submitted applications online seeking a survey of his lands, several survey numbers of M.Turkapally Village in Valigonda Mandal, Yadadri-Bhuvanagiri District, find mention in the prayer without indicating as to the extent in each of such survey numbers that required to be surveyed. He would further state that though online petitions have been submitted, details of the land to be surveyed would not be furnished.

In that view of the matter, the writ petition is disposed of permitting the petitioner to make proper applications in the prescribed format giving full details of the lands in various survey numbers of M.Turkapally Village, Valigonda Mandal, Yadadri-Bhuvanagiri District, that are to be surveyed and pay the requisite fee. In the event such

applications are submitted with full details along with the requisite fee, the second respondent shall take appropriate action thereon for undertaking the survey expeditiously.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR Date:14.02.2019 GJ
