ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents and with their consent the writ petition is disposed of at the admission stage. The case of the petitioner is that she was appointed as fair price shop dealer of Arepalli Muppalla Village, Ipuru Mandal, Guntur District, in the year 1988 on permanent basis and her authorization has been renewed from time to time. While so, the Assistant Grain Purchasing Officer, Guntur visited the shop of the petitioner, conducted panchanama and submitted a report to the 2nd respondent, who in turn issued show cause notice dated 22.12.2015 to the petitioner framing three charges, to which the petitioner submitted a detailed explanation denying all the charges.

The grievance of the petitioner is that without conducting any enquiry and without giving an opportunity to her the 2nd respondent, basing on the report submitted by the Assistant Grain Purchasing Officer, Guntur, had passed the impugned order dated 05.02.2016 cancelling the authorization of the petitioner. Challenging the same, the present writ petition is filed. Having regard to the facts and circumstances of the case, interest of justice would be met if the 2nd respondent is directed to conduct enquiry into the allegations made against the petitioner and pass appropriate orders within a time frame.

Accordingly the writ petition is disposed of directing the 2nd respondent to conduct enquiry into the allegations made against the petitioner, complete the same and pass appropriate orders within a period of 15 days from the date of receipt of a copy of this order. As a sequel, pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
