HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 1517 of 2018 Order:

It is the case of the petitioners that they inherited each Ac.0-10 gts., of land situated in Survey No.556/3 from their father late Chittari who was assigned the said land on 07.12.1967. They got their names mutated in the revenue records of the third respondent after the death of their father. While so, on 10.01.2018 the fourth respondent entered their lands and levelled the lands without issuing any notice. It is the case of the petitioners that no proceedings under the Land Acquisition Act were also taken.

If the petitioners are owners of Ac.0-20 gts., of land situated in Survey No.556/3 of Ensanpally village, Siddipet Urban Mandal, Siddipet District, the Government cannot interfere with the said land without following due process of law.

In the circumstances, the Writ Petition is disposed of directing the respondents not to interfere with the said land, provided the petitioners are having valid title, without following due process of law. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
