THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.15775 OF 2017 ORDER:

Followed by a report of the Food Inspector of Podilli, dated 02.01.2017, under Section 6-A of the Essential Commodities Act, 1955, pursuant to a show-cause notice, dated .01.2017, the Revenue Divisional Officer, Ongole, suspended the authorization of the petitioner's fair price shop, for a period of three months pending enquiry.

The grievance of the petitioner in the present writ petition is despite indicating the said period of three months in the impugned order, the respondents neither concluded the enquiry nor permitted the petitioner to run the fair price shop.

On the other hand, it is submitted by learned Government Pleader that appropriate orders will be passed, in accordance with law, after giving notice and opportunity to the petitioner herein. 4.

Having heard the learned counsel for the petitioner and learned Government Pleader, this Court is of the considered opinion that the ends of justice would be served, if the 3rd respondent-Revenue Divisional Officer, Ongole, is directed to pass appropriate final orders, within a period of six (06) weeks from the date of receipt of a copy of this order, after giving notice and opportunity to the petitioner. In the event of failure to adhere to said time limit, the petitioner is entitled to lift the stock.

With the above observation, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
