HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.1724 of 2020 ORDER :

The relief sought in the writ petition is as under: "..... this Hon'ble Court may be pleased to issue a writ order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of respondent No.2 in not releasing the petitioner's Tractor bearing Reg. No.TS 21B 2743 seized in P.O.R.No.4279/86, inspite of representation dt.16.07.2019 the readiness of the petitioner to furnish the third party surety, as being illegal, arbitrary and unjust, and consequently direct respondent No.2 to release the vehicle and to grant such other relief ....."

Heard learned counsel for the petitioner as well as the learned Assistant Government Pleader for Forests appearing for the respondents.

Learned Assistant Government Pleader appearing for the respondents informs the Court that he has instructions to report that in compliance with the procedure contemplated under Section 44 of the Andhra Pradesh Forest Act, 1967 (for short, 'the Act'), an enquiry will be conducted and appropriate orders will be passed within a period of four (4) weeks. Recording the said submission, this Writ Petition is disposed of directing the respondents to comply with the procedure contemplated under Section 44 of the Act and pass

PKR,J W.P.No.1724 of 2020 appropriate orders as expeditiously as possible, preferably within a period of two (2) weeks from the date of receipt of a copy of this order.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
