HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL MISCELLANEOUS APPEAL No.519 OF 2004 ORAL ORDER:

No representation for the appellants, despite earlier notifying the list and also re-notifying it today.

2. In fact, the Tribunal granted Rs.96,000/- as compensation with interest at 9% per annum thereon fixing joint and several liability on respondent Nos.1 and 2, who are driver and owner of the accident vehicle, while exonerating the liability on respondent No.3 - Insurer. The grounds of appeal would show that the claim of appeal is for Rs.1,00,000/-. It is not known how the amount of Rs.1,00,000/- is shown when Rs.96,000/- was already awarded by the Tribunal as against the claim of Rs.1,00,000/- laid by the appellants - petitioners.

3. Since there is no representation for the appellants, the present appeal is dismissed for non-prosecution. As a sequel thereto, miscellaneous applications, if any, pending in the appeal, stand disposed of.
