THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2456 of 2014 JUDGMENT:

This revision is filed by the petitioner-A1-owner of the property against the order dated 2.7.2014 made in C.C.No.151 of 2013 by the Judicial First Class Magistrate, Narsipatnam, Visakhapatnam District. 2.

The respondent-complainant registered a case against the petitioner and two others for the offence punishable under Sections 7-A r/w 8(e) of the A.P. Prohibition Act, and seized Hero Honda Splender Motor cycle bearing Registration No.AP31 BQ 4976. The petitioner filed an application in the above C.C. for release of the vehicle in question for his interim custody. The learned Magistrate returned the application on the ground on jurisdiction. Aggrieved by the same, the petitioner filed this revision.

When this matter has come up for hearing, the learned Additional Public Prosecutor submitted that confiscation proceedings are pending and therefore, the vehicle cannot be released.

In view of the above submission, this Court is not inclined to grant the interim custody of the vehicle in question. 5.

Accordingly, the Criminal Revision Case is dismissed. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. _____________________ JUSTICE RAJA ELANGO Dated:26th September, 2016 Nn
