THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13286 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking grant of anticipatory bail in crime No.217 of 2015 on the file of I Town Police Station, Visakhapatnam, registered for the offences under Sections 420, 468, 471 and 506 IPC read with Section 34 IPC. Heard and perused the material available on record. The allegation against the petitioner herein is that the petitioner induced the de facto complainant and his friends to invest a sum of Rs.30 lakhs on informing them that his mother was allotted a contract work from Damani Shipping Private Limited and that the petitioner has shown the contract documents and other invoices to the de facto complainant and also promised that he will give good profits on such investment. Subsequently, on enquiries, the complainant came to know that the contract documents and the invoices, which were shown to the complainant, are all forged and fake documents. Hence, the complaint.

Learned counsel for the petitioner submits that the petitioner has not committed any offence and that he is a law abiding citizen and he is ready and willing to cooperate with the investigating agency. Hence, he prays this Court to grant anticipatory bail to the petitioner herein. This Court is of the view that the petitioner knowing fully well that his mother was not allotted any contract, has shown the forged contract documents and invoices to the complainant herein. Considering the facts and circumstances, this Court is not inclined to grant anticipatory bail to the petitioners herein. The criminal petition is accordingly dismissed.
