O R D E R
The grievance of the petitioner is that the 2nd respondent - Station House Officer, Police Station, Jeedimetal, Cyberabad, is not conducting investigation in FIR. No.785 of 2018 lodged by him against one Chindurala Sruthi and five others under Sections 379, 341, 506, 323 and 447 read with 34 IPC. Learned Assistant Government Pleader for Home produced written instructions of Sub Inspector of Police, Jeedimetla Police Station, Cyberabad Commissionerate dated 1.2.2019, wherein it is stated that the police have conducted investigation in FIR.No.785 of 2018, which disclosed that accused No.
1, who is the wife of the petitioner, has taken only her gold ornaments from her matrimonial house and not any other item, as such no offence is made out against the accused persons and that investigation is completed and final report is to be filed before the court concerned. It is further stated in the written instructions that there is a counter case to the case of the petitioner in Cr.No.137/2018 under Sections 498-A, 324,l 506 IPC and Sections 3 and 4 of Dowry Prohibition Act of Jeedimetla Police Station and the same is pending investigation.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.
From the above written instructions it could be seen that the investigation in the crime lodged by the petitioner is completed and final report is to be filed. In view of the same, the 2nd respondent is directed to file final report before the court concerned, within a period of two weeks from the date of receipt of a copy of this order, after serving a copy of the same to the petitioner.
It is open to the petitioner to avail alternative remedies available under law.
The writ petition is disposed of accordingly. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
