A Vijayalakshmi v. The Government Of Andhra Pradesh Rep.By Its. Principal
THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.14617 of 2014 ORDER:
There is no representation on behalf of the petitioners. 2.
The prayer sought in the writ petition is as under:- " ... to issue an order or orders more particularly one in the nature of Writ of Mandamus directing the respondents not to interfere with the peaceful life and liberty of the petitioners without any case in the records of the police of L.B. Nagar and also direct the respondents to provide protection to the petitioners life and liberty in future and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case, in the interest of justice."
3.
Learned Government Pleader placed on record the written instructions, dated 26.05.2014, issued by the Sub-Inspector of Police, L.B.Nagar Police Station, Cyberabad.
4.
A perusal of the said instructions would reveal that the 2nd respondent never harassed, threatened and interfered with the life and liberty of the petitioners, particularly by calling them to the Police Station. In fact, no criminal cases are registered against the petitioners on the file of the Station House Officer, L.B.Nagar Police Station. As far as the allegation of the petitioners that on 18.05.2014 at the instance of the 4th respondent, the respondent police have called the petitioners, harassed them physically and mentally and detained them in Police Station is specifically denied. It is also stated in the
instructions that there was a matrimonial dispute between the petitioners and the 4th respondent herein. The petitioners are unnecessarily involving the respondent police into the matrimonial litigation. The respondent police have nothing to do with it. It is also stated in the instructions that the present writ petition has been filed as a precautionary measure, if the 4th respondent registers any complaint against the petitioners, so that the respondent police cannot take any action against them.
5.
In view of the said specific instructions, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.
6.
Accordingly, the writ petition is dismissed.
Miscellaneous petitions pending, if any, shall stand dismissed. No costs.
