Shaik Kadheerunnisa v. The Station House Officer, I Tonw (U/G) Police Station

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8296 of 2012 ORDER:

This writ petition was filed to quash Crime No.52 of 2012 on the file of the I Town (U/G) Police Station, Kadapa City, registered against the petitioners under Sections 323 and 503 I.P.C., read with Section 3(1) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.

By order dated 27.03.2012, this Court permitted the police authorities to continue with the investigation in the said crime but stayed the arrest of the petitioners pending further orders. Relying on the written instructions received from the concerned police authorities, the learned Assistant Government Pleader for Home informed this Court that after due investigation in Crime No.52 of 2012, a charge sheet was laid before the learned I Additional Judicial First Class Magistrate, Kadapa, which was taken on file in C.C.No.16 of 2014. After a full-fledged trial, the accused were acquitted under Section 235(1) Cr.P.C.

In the light of the aforestated developments, the grievance of the petitioners in this case no longer survives for consideration as they have already been acquitted by the competent criminal Court in connection with Crime No.52 of 2012.

The writ petition is accordingly dismissed.

Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
