Public Prosecutor, for the Respondenl, the Court made the following.
&u THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.643 of 2021 ORDER:
This Crimirral Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A4 seeking to grant anticipatory bail in the event cf his arrest in Cr.No.2 of 2021 on the file of Kethapally Police Station, Nalgonda District, registered for the offence punishable under Section 304-8 lPC.

Heard learned counsel for the petitioner/A4, learned Additional Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioner/A4 would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been lalsely implicated in the crime. He further submits that the petitioner is studying B.Sc Final year in Nizam College, Basheer Bag, Hyderabad, and if he is arrested, his career will be spoiled. He further submits that the pe,titioner is staying at hostel and is preparing for his final year examinations and as such there is no question of demand of additional dowry. t{e also submits that the petitioner is law abiding citizen and he is ready tc abide by any condition that may be imposed by this Court in the event of his enlargement on anticipatory bail. 4.
Learned Additional Public Prosecutor vehemently opposed to grant anticipatory bail to cetitioner, but conceded to the fact that except general allegations that the petitioner along with other accused has demanded additional dowry, ro specific allegation whatsoever has been attributed against him. He also submits that Al to A3 have already been arrested and the entire investigation is completed, except filing of the charge sheet. 5.
A perusal of ':he record goes to show that the petitionerA4 is brother of A1 and son of A2 and A3 and only general allegations are made against
\ #l \ the petitioner that he along with the other accused has demanded the deceased to bring additional dowry of Rs.10 lakhs, but there are no specific allegations attributed against the petitioner. The petitioner is a Student of B.Sc final year, at Nizam College, Basheer Bagh, Hyderabad, and is staying at Hyderabad for the last three years and he is preparing for final year examinations. Thus, looking into the nature of allegations against the petitioner, lam inclined to grant anticipatory bail to the petitioner/A4.

The Criminal Petition is accordingly allowed and the petitioner/A4 is granted anticipatory bail subject to the following terms and conditions:
(1) The petitioner/A4 is directed to surrender before the Station House Officer, Kethapally Police Station, Nalgonda District, within a period of 15 days from the date of this order and on such surrender, the said Station House Officer shall release the petitioner/A4 on bail on his executing a personal bond to the tune of Rs.25,000/- (Rupees tWenty five thousand only) with two sureties for the like sum to his satisfaction.
(2) On such release, the petitioner/A4 shall appear before the lnvestigating Officer on every Sunday between 10.00 AM to 2.00 PM till completion of investigation or filing of the charge sheet whichever is earlier.
(3) The petitioner/A4 shall abide by the other conditions stipulated in Section a3B(2) Cr.P.C.
(4) The petitioner/A4 shall not misuse the liberty granted to him. 7.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
