SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.4 7 3 of 2 0 1 8 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A1, in Crime No.423 of 2015 on the file of Gachibowli Police Station, Rangareddy District. The offences alleged are under Sections 419, 420 and 471 IPC. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

3.

The case of the prosecution is that this petitioner, who is the relative of the de facto complainant, colluded with other accused in collecting amounts from the de facto complainant, under the guise of income tax dues. In fact, the other accused, who represented themselves as people from the Income Tax Department, were not from the Income Tax Department. This petitioner and the other accused colluded and collected the amount from the de facto complainant.

4.

When such is the case of the prosecution, this court opines that this is not a fit case for granting anticipatory bail to the petitioner.

5.

With the above observations, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed,

expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
