ORDER:
Petitioner alleges that police are interfering with personal life, liberty and freedom of the petitioner by calling him to the police station and harassing him by involving in the civil dispute.
According to the written instructions furnished by Station House Officer, Mahabubnagar II Town P.S., Mahbubnagar District dated 06.02.2019, one B.Kista Reddy gave a complaint on 16.08.2018 to the Superintendent of Police, Mahbubnagar District alleging that petitioner has taken amount from his daughter to provide land and did not provide any land to him. After making a GD entry on the said complaint, the Station House Officer called the petitioner to the Police Station as the complaint was given against the petitioner but the petitioner did not turn up.
The instructions show that further steps are taken but so far no crime was registered on the complaint given on 16.08.2018. In a given case, police need to conduct preliminary investigation before registering the crime but they cannot call the petitioner to police station under the guise of enquiry into the mater.
Therefore, the respondents are directed not to call the petitioner to police station unless required in a crime registered against him, in accordance with law.
Accordingly, the writ petition is disposed of. No order as to costs.
As sequel to it, Miscellaneous Petitions, if any pending, shall stand dismissed.
