SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.4 8 4 of 2 0 1 8 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is Accused, in Crime No.150 of 2017 on the file of Mirchowk Police Station, Hyderabad District. The offences alleged are under Sections 341, 323, 506 r/ w 34 IPC and Section 25 (1) of Arms Act.

2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

3.

The allegation against this petitioner is that he has instigated the attack on the de facto complainant along with his supporters and they were armed with Talwar and sticks. 4.

Counsel for the petitioner submits that the CCTV footage collected with regard to the incident does not show anything with regard to Talwar and sticks.

5.

Learned Public Prosecutor, however, does not speak about the collection of CCTV footage and he further submits that the petitioner herein is involved in 20 other cases. Moreover, earlier the petitioner sought for anticipatory bail and the same was dismissed by virtue of order dated 04.01.2018 passed in Crl.P. No.24599 of 2017, by considering the merits. 6.

Hence, this court opines that this is not a fit case for granting anticipatory bail.

7.

With the above observations, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
