HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioners challenge the notice dated 17.11.2016 on various grounds. Learned counsel for petitioners contends that notice is addressed to a person, who died long ago and wrong description is also given. According to the learned counsel, Gangaram died on 26.12.2007. Further the father's name of the Gangaram is Krishnaji, whereas it was mentioned as Ramulu. Pointing out these defects, representation was also filed on 21.11.2016 by the first petitioner. 2.

Having regard to these infirmities pointed out, the Commissioner of respondent Municipality is directed to examine the records and cause notice on the person in occupation of the said premises. According to the petitioners, they are presently in occupation of the subject premises. The Commissioner shall cause notice afresh on the petitioners in the address given by them and as and when notice is caused, petitioners shall reply the same with out protest and file their reply/objections by enclosing all the relevant material in their support within the time granted. If no explanation is filed, even though sufficient time is granted, it is open to the competent authority of the Municipality to pass appropriate orders and to take action as warranted by law. Writ petition is disposed of accordingly.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
