HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.9510 of 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Home.
The grievance of the petitioner is that though FIR No.553 of 2014 was registered on 10-09-2014, the 3rd respondent has neither investigated the case nor filed charge-sheet. She also points out several lapses on the part of the Investigating Officer and states that though C.C. T.V. footage is available, the 3rd respondent has neither identified the chain snatcher nor has taken any steps to apprehend him and his vehicle. It is the specific allegation of the petitioner that instead of searching for the suspected person, the 3rd respondent has concentrated his energy in trying to establish that the petitioner has neither purchased the gold chain nor was wearing it. On the allegation that the investigation made by the 3rd respondent is not fair and proper, it is pleaded in the writ petition to transfer the investigation to Central Crime Station.
Learned Government Pleader for Home has received instructions, which state that the investigation is completed, but no useful information is obtained with regard to the suspected person. It is stated that though the case is pending from August, 2014, as no clues are available, permission is sought from the Deputy Commissioner of Police, North Zone, Secunderabad, to refer the case as "Undetected". It is also stated that the final report is not yet filed. Keeping in view the serious allegations of the petitioner and in order to verify the truth or otherwise, it is necessary that the investigation so far conducted by the 3rd respondent is reviewed and overseen by the superior officer, so that any corrective steps, if required, can atleast be taken now. Since no final report is filed so far, I deem it appropriate to dispose of the writ
petition by directing the 2nd respondent to nominate a superior officer of his choice to oversee and review the investigation made by the 3rd respondent and also authorize such nominated officer to take all necessary steps to conduct further investigation, if any required, and then take all necessary steps in accordance with law. No order as to costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
