This writ petition is filed by the petitioners seeking a writ of Mandamus to declare the action of the respondents 2 to 4 in marking portions of petitioner's building properties connected to the main road bearing D.No.3.6.41 (Assessment No.1076003094), Dr.No.3-2-1 (Assessment No.1076003091), Dr.No.3-6-38 (Assessment No.1076003107), of Meraka Street (AKP Road), Kovvur Municipality, West Godavari District, for road widening purpose as illegal and violative of principles of natural justice, and also the provisions of Andhra Pradesh Municipalities Act and rules framed there under and the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 and the Provisions of Land Encroachment Act and for a consequential direction to the respondents 2 to 4 not to demolish any portion of the petitioners building structures.
Heard Sri K.Venu Madhav, learned counsel for the petitioners and learned Government Pleader for Municipal Administration, appearing for respondents 1 and 2, learned Government Pleader for Revenue, appearing for respondent No.3 and Sri Nimmagadda Venkateswarlu, learned counsel for the fourth respondent and perused the record.
At the time of hearing, it is stated by the learned counsel for the petitioners that in similar circumstances, this Court disposed of Writ Petition No.6730 of 2015 and the same is not disputed by Sri Nimmagadda Venkateswarlu, learned counsel for the fourth respondent. Hence, this writ petition is also disposed of in terms of the order dated
18.03.2015 in W.P.No.6730 of 2015, directing the respondents not to demolish the structures of the petitioners properties without following due procedure prescribed under law. No order as to costs.
