THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No. 2225 of 2007 ORDER:

The grievance of the petitioners in the present writ petition is non-consideration of their applications for grant of freedom fighters pension under Swathantra Sainik Sanman Pension Scheme, 1980. Heard Sri S. Srinivas Reddy, learned counsel for the petitioners, and Sri M. Ramesh Reddy, learned Standing Counsel for Central Government for the first respondent. According to the petitioners, they participated in freedom struggle and their cases are entitled to be considered for grant of pension under Swathantra Sainik Sanman Pension Scheme, 1980. It is averred in the affidavit filed in support of the writ petition that the petitioners submitted applications for grant of freedom fighters pension and the first respondent forwarded 240 applications including the applications of the petitioners for enquiry to the second respondent vide letter D.

O.No.112/836/99-FF (HC) dated 03.05.1999, but so far no action has been taken. A counter affidavit is filed on behalf of the first respondent stating that the claims of the petitioners can be considered only after receipt of the Verification Reports from the State Government with regard to their claims.

No counter affidavit is filed by the State Government - respondents 2 and 3.

Having heard the learned counsel for the petitioners and the learned Standing Counsel for Central Government, and on considering the facts and circumstances of the case, this Court deems it appropriate to dispose of the writ petition by directing

respondents 2 and 3 to take appropriate action pursuant to the above referred letter dated 03.05.1999 addressed by the first respondent to the second respondent, within a period of three months from the date of receipt of a copy of this order and send a report to the first respondent for taking necessary action in this matter. If the said report is sent by respondents 2 and 3, the first respondent shall consider the issue and take appropriate action within three months thereafter, in accordance with law. Consequently, Miscellaneous Petitions, if any pending in this writ petition shall stand disposed of. There shall be no order as to costs.
