O R D E R
This writ petition was filed seeking a direction to the police authorities not to arrest the petitioner as his name was not mentioned in the complaint or anywhere in Crime No.39 of 2011 on the file of Kotananduru Police Station, East Godavari District.
The Sub-Inspector, Kotananduru Police Station, East Godavari District, filed a counter-affidavit stating that on a complaint lodged by one Kattu Yesu, Crime No.39 of 2011 was registered under Section 3(i)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 read with Section 34 IPC against 31 persons on the file of Kotananduru Police Station. One of the accused in the said crime was Thamarla Srinu (A.30). When the police were trying to trace his whereabouts and went to the village, the petitioner, whose name is Thamarla Venkata Satyanarayana, is stated to have apprehended that action may be taken against him as his name is similar and filed the present writ petition.
The SubInspector further stated that the police had no intention of summoning the petitioner to the police station and that the writ petition was filed on a mere apprehension. The stand of the police authorities is taken on record. In the light thereof, it is clear that the grievance of the petitioner was ill-founded and without basis. The writ petition is accordingly dismissed. Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
