HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITON No.1847 of 2019 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents in not considering the case of the petitioner as 'medically unfit' case to the post of 'Security Guard' or 'RTC Constable' as per circular No.PD-17/2017, dated 27.07.2017, as arbitrary and illegal and violation of Articles 14 & 16 of Constitution of India and sought consequential direction to direct the respondents to consider the case of the petitioner to the post of Security Guard or RTC Constable as per Circular dated 27.07.2017 by considering the petitioner's representations dated 29.03.2018 and 14.09.2018.

Heard Sri K.Venkateswarlu, learned counsel for the petitioner and Sri B.Mayur Reddy, learned Standing Counsel for respondents.

It has been contended by the petitioner that his father was employed with the respondent Corporation who was declared as medically unfit on 14.09.2018; that his father has left over service of more than 15 years; and that he has submitted representations dated 29.03.2018 and 14.09.2018 requesting the respondents to consider his case for appointment as Security Guard or RTC Constable on compassionate grounds under bread winner scheme, but, so

far the respondents have not passed any orders on the said representations.

Learned Counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the representations submitted by the petitioner on 29.03.2018 and 14.09.2018 and pass appropriate orders, in accordance with law.

Learned Standing Counsel appearing for the respondents submitted that the case of the petitioner would be considered in accordance with law and appropriate orders would be passed.

Having regard to the aforesaid submissions of parties, the writ petition is disposed of directing the respondents to consider the representations submitted by the petitioner on 29.03.2018 and 14.09.2018 and pass orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. No order as to costs. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
