2THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.1809 OF 2020 ORDER:
The present Writ Petition is filed to declare the action of respondent Nos.4 to 8 in calling the petitioner to their respective offices at the behest of the 9th respondent without there being any complaint against the petitioner, as illegal, arbitrary and unconstitutional.
Heard Sri P. Vamsheedhar Reddy, learned Counsel for the petitioner and learned Assistant Government Pleader for Home. Learned Assistant Government Pleader for Home, on written instructions dated 12.02.2020, submits that the 5th respondent authority called the petitioner on 25.01.2020 to know the actual details of the person, who is using phone number 9848085932 and enquired as to who is the person who has answered the said call. It is stated that the said respondent authority never called the petitioner to his office at any time. In so far as the 7th respondent authority is concerned, it is stated that there are three crimes registered against the petitioner vide Crime Nos.285 of 2013, 14 of 2014 and 376 of 2017 wherein in respect of Crime No.285 of 2013 and 14 of 2014, charge sheets have been filed and the cases are pending trial vide C.
C. No.286 of 2014 and C.C. No.737 of 2015 and in C.C. No.737 of 2015, NBWs pending against the petitioner. In so far as the case in Crime No.376 of 2017 is concerned, the same has been referred as lack of evidence.
petitioner at any time and, in fact, the respondent authorities are taking steps to execute the NBWs pending against the petitioner. Recording the said submissions made on behalf of the official respondents wherein it has been categorically stated that the 5th respondent authority did not call the petitioner to the office any time except making a call on 25.01.2020 for the reason as noted hereinabove and in so far as the 7th respondent is concerned, wherein it is stated that the respondent has not called the petitioner and, on the other hand, is seeking to execute the NBW pending, no further orders need be passed in the matter. Accordingly, the Writ Petition is closed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
