HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.18506 of 2015 ORDER :
Petitioners claim to be the residents of Medipally village, Ghatkesar mandal, Ranga Reddy District. They own house plots in Sy.No.62/1 of Medipalli Village. Lay out was approved by the Hyderabad Urban Development Authority (HUDA) on
01.04.2000.
Petitioners have submitted applications for grant of permission to construct houses in the plots owned by them on 10.02.2015, but so far no permission is granted. Hence, this writ petition.
2. Learned standing counsel submits that so called applications submitted by the petitioners do not contain the date on which said applications were submitted and the same were also not in accordance with the proforma prescribed in Form-G appended to the A.P.Gram Panchayat Land Development (Layout and Building ) Rules, 2002 (for short, 'Rules, 2002').
3. Since the petitioners have not submitted applications in accordance with the procedure prescribed in the Rules 2002, it cannot be said that the respondent Gram panchayt has acted illegally in not considering the so called applications submitted by the petitioners.
4. Accordingly, the writ petition is disposed of granting liberty to the petitioners to submit their applications in accordance with the procedure prescribed in Rules 2002 and as and when such applications made, the same shall be considered by the respondentGram Panchayat within a period of four weeks thereafter. There shall be no order as to costs.
