THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No.499 OF 2022 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C., to quash the proceedings in C.C.No.745 of 2021, pending on the file of Junior Civil Judge at Kothagudem. The petitioners herein are Accused Nos.3 and 4 in the said CC. The offences alleged against them are under Sections 498-A of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961.

Heard the learned counsel for the petitioners and the learned Public Prosecutor. Perused the record. 3.

As per the contents of the charge sheet in C.C.No.745 of 2021, marriage of A-1 with the 2nd respondent was performed on 14.08.2020. Thereafter, matrimonial disputes arose between them. The 1st petitioner is mother and 2nd petitioner is unmarried sister of A-1. In the said charge sheet, the allegations against the petitioners are general in nature and they are triable issues. Therefore, this Court is not inclined to quash the proceedings in C.C.No.745 of 2021. In matrimonial disputes, identification of parties is not in dispute.

Considering the above said facts, this Criminal Petition is disposed of dispensing with the presence of petitioners/A-3 and A-4 in C.C.No.745 of 2021, pending on the file of Junior Civil Judge, Kothagudem. However, petitioners

herein shall appear before the said Court as and when their presence is required.
