HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.32471 of 2015 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for respondents 1 to 4. The petitioners' request for grant of pattadar passbooks and title deeds was rejected by the Tahsildar, Bhongir Mandal, Nalgonda District, the 4th respondent, vide impugned order, dated 04.09.2015.
It is stated by learned Government Pleader for Revenue that recently a Divisional Bench of this Court has held that the appeals against such orders are not maintainable. Even if that be so, the petitioners can always avail the remedy under Section 9 of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 and then agitate the correctness or otherwise of the impugned order before such authority. Since the petitioners have an efficacious alternative remedy, I am not inclined to entertain the Writ Petition. The Writ Petition is accordingly dismissed giving liberty to the petitioners to avail the alternative remedy. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
