HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3117 of 2016 ORDER:
This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioner-accused No. 3 challenging the docket order, dated 22.12.2009, in CC No.315 of 2008 passed by the I-Additional Judicial Magistrate of First Class, Mancherial, Adilabad District. The offences alleged against the petitioner are punishable under Sections 420 and 273 IPC. Learned counsel for the petitioner submitted that originally the case was pending before the Judicial Magistrate of First Class, Luxettipet and the petitioner used to appear regularly before that Court and thereafter, the case was transferred to the Court of I-Additional Judicial Magistrate of First Class, Mancherial, but the petitioner has no knowledge about the same and in the meantime, the learned Magistrate has issued NBW against the petitioner on 22.12.2009 since he was absent before the Court.
Having heard the learned counsel for the petitioners and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that this criminal petition can be disposed of with the following directions: The petitioner-accused No.3 is directed to appear before the Court concerned and file a petition to recall the NBW issued against him and on such petition being filed, the Court concerned is directed to recall the NBW on the same day on petitioner executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for a like sum each and further the petitioner is directed to appear before the trial Court on all hearing dates.
Accordingly, the Criminal Petition is disposed of.
Consequently, the Miscellaneous Petitions pending if any, shall stand closed.
