THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.13213 of 2013 ORDER :

Petitioner's brother was assigned a house site in 1992 and later petitioner's brother constructed a house through a Housing Board. Subsequently he died in 1995.

Thereafter petitioner's mother was in possession of the house. She went to stay with the petitioner for medical check up and later she died and petitioner inherited the said house. 3.

Petitioner entrusted the house to the 5th respondent allegedly in order to maintain a light in the house for some days, but the 5th respondent did not vacate the house. Therefore the petitioner gave representation on 27-11-2011 to respondent Nos.1 to 4 to evict the 5th respondent. He then filed the Writ Petition stating that the said representation was not disposed of.

Since the petitioner can approach a Civil Court to evict the 5th respondent, who is allegedly in unauthorized occupation of the house constructed by petitioner's brother, which petitioner claims to have inherited, granting petitioner liberty to approach the competent Civil Court for the said purpose, the Writ Petition is disposed of. No costs.

As a sequel, miscellaneous petitions, if any pending in this Writ Petition, shall stand closed.
