CVNR, J & TA, J IA.No.1 of 2018 in/& CMA.No.500 of 2017 Dt: 14.11.2018 Common Judgment: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) The unsuccessful petitioner in OP.No.2 of 2015 on the file of the Senior Civil Judge, Kadiri, filed CMA.No.500 of 2017 challenging the dismissal of the said OP filed by him for dissolution of his marriage with the respondent under Section 13

(1) (ia) (ib) of the Hindu Marriage Act, 1955 (for short 'the Act'). IA.No.1 of 2018 is filed by the appellant to permit him to amend the prayer in the aforesaid OP by substituting the prayer 'for dissolution of marriage on the grounds of cruelty and desertion' with 'grant divorce by mutual consent under Section 13(B) of the Act'. In support of this Application, the appellant and the respondent have filed separate affidavits wherein they have averred that they have settled the dispute by mutual consent, as per which, the appellant has agreed to pay a sum of Rs.13 lakhs towards full and final settlement of all the claims of the respondent including permanent alimony.

At the hearing, both the parties are personally present. They reiterated the contents of the affidavits filed by them and requested the Court to dissolve their marriage by mutual consent. Having regard to the facts noted above, IA.No.1 of 2018 is allowed and OP.No.2 of 2015 on the file of the Senior Civil Judge, Kadiri, as amended, is decreed by dissolving the marriage between the appellant and the respondent under Section 13 (B) of the Act.

CVNR, J & TA, J IA.No.1 of 2018 in/& CMA.No.500 of 2017 Dt: 14.11.2018 The CMA is, accordingly, allowed.
