HON'BLE SRI JUSTICE D.V.S.S. SOMAYAJULU I.A.No.1 of 2018 and Second Appeal No.73 of 2015 JUDGMENT:
The petitioner/appellant and the second respondent are present before this Court.
Both the learned counsel are present and they state that the first respondent is not necessary party and he is only a pro-forma party. The identity of both the parties is proven by both the learned counsel. The appellant produced her aadhaar card and the second respondent produced her election card. Photostat copies of the same are filed and the same are countersigned by both the learned counsel. Both the parties agreed that the terms of the compromise are willingly and voluntarily entered into by them. They also state that they have entered into the compromise on their own wish and volition only. In this view of the matter, the compromise is recorded. IA No.1 of 2018 is accordingly allowed. The recorded terms of the compromise shall form a part of the judgment and decree whenever the same is issued to the parties.
Consequently, the appeal is disposed of in terms of the compromise. In the circumstances of the case, there shall be no order as to costs. Miscellaneous Petitions, if any pending in this appeal shall stand closed.
