HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.1915 of 2019 ORDER:

This writ petition is filed seeking a Writ of Mandamus declaring the action of respondents 2 and 3 in not considering the representation submitted by the petitioner on 03.03.2018 seeking review of the order of discontinuation of service of the petitioner as Lecturer in Political Science on contract basis by taking into consideration his unblemished service of 16 years as well as medical record submitted to them as illegal and arbitrary and sought a consequential direction to the respondents to take back the petitioner into service as Lecturer in Political Science in any of the vacancies available in Suryapet District. Heard Mr.V.Brahmaiah Chowdary, learned counsel for petitioner and the learned Government Pleader for Higher Education.

It has been contended by the petitioner that he was appointed as Lecturer on contract basis during the year 2001 and the tenure of the petitioner has been extended from time to time. He is fully eligible and qualified to be appointed as Lecturer in Political Science. However, his contract service has not been renewed with effect from 01.04.2017 on the ground that he has not attended duty on 01.04.2017 due to ill health. The petitioner further submits that he has submitted a representation on 03.03.2018 requesting to re-engage him as Lecturer on contract basis.

The grievance of the petitioner is that the respondents are not considering his representation submitted on 03.03.2018 nor re-engaging him as a Lecturer on contract basis. Learned counsel for petitioner contends that appropriate orders be passed directing the respondents to consider the representation submitted by the petitioner on 03.03.2018 and pass appropriate orders in accordance with law.

Learned Government Pleader appearing for respondents has contended that the representation submitted by the petitioner on 03.03.2018 will be considered and appropriate orders would be passed in accordance with law.

This Court, having considered the submissions made by the learned counsel for the parties, is of the considered view that the writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 03.03.2018 and pass appropriate orders in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
