WHEREAS the Petitioner above named through his Advocate M/s G. RAMAN GOUD presented this Petition under Article 226 ol lhe Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, order or direction, more particularly one in the nature of a Writ of Mandamus declaring the action of respondents in recovering an amount of Rs.7,57,7021 from the gratuity amount payable to petitioner without calling for any explanation from petitioner and straight away recovering the said amount of Rs.7,57,7021- vide proceedings of the third respondent in Lr.No.AG(A&E)|P14l1lB108/SP161/2019-05815 dated 07.06.2019 on the basis of fourth respondents letter no.2257120171F3 dated 06/05/2019 as arbitrary, illegal and consequently direct the respondents to release the amount of Rs.7,57,702l- with interest at 12% per annum from the date of petitioners retirement i.e., 30.06.2017 till the date of realization of the amount.
AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of M/s. G. RAMAN GOUD, Advocate for the Petitioner, directed issue of notice to the Respondents herein returnable in four weeks to show cause as to why this WRIT PETITION should not be admitted. You viz:
