SMT JUSTICE T.RAJANI CRIMINAL PETITON No.497 OF 2018 ORDER:

This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioner, who is sole accused, on bail in Crime No.14 of 2017 on the file of the Cheedikada Police Station, Visakhapatnam District. The offences alleged are under Sections 20(b)(1)(ii)(c) r/w 8(c) of NDPS Act. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that except the confession of the accused, there is no other material and that there is no seizure.

Per contra, the public prosecutor submits that the petitioner is the sole accused and the contraband was seized from the possession of the accused. A perusal of the mediators report shows the same.

Hence, considering that the quantity of contraband involved in this case is commercial quantity and it is hit by Section 37 of NDPS Act, this court is not inclined to grant bail.

Accordingly, the Criminal Petition is dismissed.

Miscellaneous applications, if any pending, in this case shall stand closed.
