HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.4119 OF 2010 ORDER:

The present writ petition came to be filed seeking to declare the proceedings dated 10.12.1998, issued by the 2nd respondent and also to declare the action of the 1st respondent in not passing any order in stay petition or appeal filed by the petitioner on 4.2.2010, as arbitrary and illegal.

The main grievance of the petitioners is that though they have filed an appeal along with the stay petition against the orders passed by the 3rd respondent-Tahsidlar before the 1st respondent-District Collector, way back in the year 2010, the same is still pending and no orders are passed either on the stay petition or in the main appeal. Hence, the present writ petition came to be filed.

When the matter is taken up for hearing, learned Government Pleader for Revenue would submit that the writ petition may be disposed of directing the 1st respondent-District Collector, to dispose of the appeal filed by the petitioner in accordance with law. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 1st respondent-District Collector, to dispose of the main appeal dated 4.2.2010 in E/1290 of 2017, if it is not already disposed of, as early as possible, preferably within a period of three months from the date of receipt of copy of this order, in accordance with law, by giving the opportunity of hearing to the petitioner and all concerned.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
