HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.14206 of 2017 ORDER:

The case of the petitioners is that the 1st petitioner is the owner of land to an extent of Ac.5-82 cents in Sy.No.106/1 and Ac.1-42 cents in Sy.No.106/1-1 and the 2nd petitioner is the owner of land to an extent of Ac.0-80 cents in Sy.No.106/1-1 of Rebala Village of Buchireddypalem Mandal, SPSR Nellore District. The petitioners are raising the paddy crop in the above lands drawing water from Gudapalli irrigation channel covered by Sy.Nos 1061/2A, 2B, 2c, 2D, 2E, 2F, 2G, 2H etc., and the encroachers have constructed houses on road margin by occupying the channel.

The petitioners made representation to the respondents 2 and 3 to remove the encroachments of channel and restore the same. It is further stated that the Assistant Engineer, Irrigation Section, Kovur has addressed a letter No.9 Kv, dated 09-03-2017 to the 3rd respondent requesting to depute Mandal Surveyor to conduct the survey of the channel and fix boundaries and take action for removal of encroachments and to restore the channel. But the 3rd respondent has not taken any action. Aggrieved by the same, the present writ petition is filed.

Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue. In view of the above facts and circumstances of the case, the 3rd respondent is directed to take appropriate action on the letter dated 09-03-2017 submitted by Assistant Engineer, Irrigation Section, Kovur and take action accordingly.

With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
