N.Venkateshwarlu v. State Of Telangana
SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.5 0 3 of 2 0 1 8 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A6 & A9, in Crime No.280 of 2015 on the file of Manchal Police Station, Cyberabad. The offences alleged are under Sections 406, 420, 468 and 471 IPC. 2.
Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.
3.
The counsel for the petitioners submits that A3 was granted regular bail. The allegations against these petitioners are that they created fake pahanies and pass books and the same were attested by MRO, VRO stamps and signatures, for obtaining crop loans in the name of villagers, from Telangana Grameena Bank at Bodakonda Branch by making the bank officials to believe that they are genuine.
4.
From the above allegations, prima facie, it appears that the petitioners have committed the alleged offences. The nature of the offences does not entitle the petitioners for an anticipatory bail. Hence, this court opines that this is not a fit case for granting anticipatory bail.
5.
With the above observations, the Criminal Petition is dismissed. However, the petitioners can file a petition seeking for regular bail by surrendering themselves before the court below. The court below shall dispose of the bail application, if
any filed, expeditiously, preferably on the same day, subject to the pressure of other work.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
