Learned counsel for the petitioner does not press this C.R.P and seeks liberty to the petitioner to challenge the order impugned in the present C.R.P in appeal suit, if the suit is decreed against it.

C.R.P is disposed of as withdrawn with liberty as prayed. All contentions of the parties are kept open.
