This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/A.4 seeking anticipatory bail in connection with Crime No.5 of 2026 of Jaipur Police Station, Ramagundam District. The offences alleged against the petitioner are under Sections 316(5), 318(4) r/w.3(5) of of Bharatiya Nyaya Sanhita,

- 2 - 2023 (for short 'BNS') and under Section 7 of Essential Commodities Act.

The case of the prosecution is that the defacto complainant lodged a complaint before police on 09.01.2026 stating that A.1 working as DCMS PPC in charge of Kishtapur Village in connivance with other accused had misappropriated and manipulated the records of truck chits on fake deliveries and by boosting the agriculture yield as if physically received in the centre and delivered to the millers and thereby mismanaged the accounts for his personal gain and 1659 quintals of paddy was moved to various rice mills and established as an excess quantity than the actual yield by booking fictitious entries for an amount of Rs.38,15,700/- and the petitioner herein is also shown as one of the farmer showing excess quantity for yielding. Hence, complaint was registered against the accused for the above offences.

Heard Sri S.Nagesh Reddy, learned counsel appearing for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that petitioner herein is arrayed as A.4 for the above offences,

- 3 - whereas Section 316(5) of BNS is not applicable to the petitioner as he is not a public servant and the similarly situated accused were served with notice under Section 35(3) of BNSS. As such, requested this Court to grant anticipatory bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed bail contending that the allegations against the petitioner are that he along with A.1 conspired together to cheat the Government. Hence, petitioner is not entitled for bail and prayed this Court to dismiss this criminal petition. 6.

Considering the submissions made by both the counsel and the material placed on record, the petitioner herein is farmer who has shown the yield excess to the extent of land he is holding, whereas, he is not an employee of DCMS PPC. Considering the same, the petitioner is granted anticipatory bail subject to the following conditions :

i.

The petitioner/A.4 shall surrender before the Station House Officer, Jaipur Police Station, Ramagundam District within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.

The petitioner/A.4 shall appear before the concerned SHO between 09.00 a.m and 05.00 p.m., on every Wednesday and Saturday for a period of eight (8) weeks, for the purpose of investigation or till filing of charge sheet whichever is earlier and thereafter, as and when required.

iii.

The petitioner/A.4 shall abide by the other conditions stipulated in Section 482 (2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous petitions, if any, pending shall stand closed.
