HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.17795 of 2017 ORDER:

The petitioner challenges notice in ROC No.2610/ 2015 dated nil.05.2017.

Learned counsel for petitioner, after arguing the writ petition for a while requests the Court to grant four weeks time for filing objections both preliminary as well as on merits before the 2nd respondent and also requests the court to direct the 2nd respondent to consider each one of the objections, afford opportunity and pass orders in accordance with law.

The alternate submission is taken note of. As a few preliminary objections, which go to the very entertaining of appeal have been canvassed, I am satisfied that the writ petition can be disposed of by this order.

The petitioner is given four weeks time from today to file objections before the 2nd respondent by enclosing a copy of this order to the notice impugned in the writ petition.

It is made clear that the 2nd respondent is under obligation to consider each one of the objections raised by the petitioner and dispose of

the appeal after affording opportunity to petitioner.

The writ petition is accordingly disposed of. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J Dt: 06-06-2017 Prv
