The grievance of the petitioner in this case was that the police authorities were not providing protection as per the orders passed in I.A.No.62 of 2010 in O.S.No.70 of 2005 by the learned Junior Civil Judge, Peddapalli, Karimnagar District.

The Station House Officer, Dharmaram Police Station, Karimnagar District, filed a counter-affidavit stating that he went to the spot to provide police protection pursuant to the order of the civil court referred to supra but, upon verifying the boundaries, he found inconsistencies and therefore the civil court was informed of the same. Sri V. Sai Kumar, learned counsel for the petitioner, stated that the discrepancy as to the boundaries was rectified by the learned Junior Civil Judge, Peddapalli, in I.A.No.156 of 2011 in O.S.No.70 of 2005, which was filed for amendment of the boundaries of the suit schedule lands in O.S.No.70 of 2005. The said I.A. was allowed by the learned Junior Civil Judge, Peddapalli, by order dated 28.11.2012.

In the light of the afore-stated development, the police authorities would be bound to give effect to the order passed by the learned Junior Civil Judge, Peddapalli, in I.A.No.62 of 2010 in O.S.No.70 of 2005 in the light of the changed circumstances as regards the description of the suit property. The learned Assistant Government Pleader for Home stated that as per the written instructions furnished by the Station House Officer, Dharmaram Police Station, the police undertook to abide by the said order passed by the civil court as long as it is in force. Taking note of the said undertaking, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
