THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.1537 OF 2018 ORDER:

When the matter is taken up, written instructions, dated 01.02.2018, furnished by the Station House Officer, Mahabubabad Town Police Station, Mahabubabad, Mahabubabad District are placed on record by the learned Government Pleader for Home. The said instructions read as under:- "On a complaint of the petitioner herein lodged with the Police of Mahabubabad Town Police Station, a case in Cr.No.218/2017 U/secs.384, 447, 427, 290, 506 r/w.34 IPC dated 4.7.2017 was registered against Mr.Konda Yellaiah and others who are some of the unofficial respondents herein and investigation was taken up.

During the course of investigation into the case, the investigation officer examined the complainant/petitioner and some other witnesses and recorded their detailed statements.

As per the evidence, the accused A1 Mr.Kondra Yellaiah (6th respondent herein) was arrested on 7.7.2017 and remanded him to judicial custody.

While the investigation is under progress, the accused A3, A4 and A5 surrendered before the Hon'ble Court of Prl.

Judl.

Magistrate of First Class at Mahabubabad on 31.1.2018 and enlarged on bail vide Dis.No.96 dated 31.1.2018.

It is pertinent to submit that almost the averments made in the affidavit are the subject matter of investigation in Cr.No.218/2017, for which, a detailed investigation is under progress. A1 was arrested on 7.7.2017. A3, A4 and A5 were surrendered before the Hon'ble Court and enlarged on bail on 31.1.2018. The

rest of the accused are absconding. Efforts are going on to apprehend the remaining accused. I assure to this Hon'ble Court that the investigation will be completed as expeditiously as possible and an appropriate report will be filed before the concerned Hon'ble Court at the earliest.

In view of the above facts and circumstances, I pray this Hon'ble Court to grant some more time to the investigating agency for completion of the full-fledged investigation into the case."

Having regard to the above said instructions, the Writ Petition stands disposed of, by placing on record the above said instructions, with a direction to the police to complete the investigation as expeditiously as possible. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
